By accessing and using the EatNSay mobile applications, website, and services ("Services"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms & Conditions, please do not use our Services.
These Terms & Conditions apply to all EatNSay products and services, including:

EatNSay is a food ordering and restaurant management platform that connects customers with restaurants and facilitates food delivery. We provide: (a) a customer app for browsing menus, placing orders, and receiving deliveries; (b) a POS app and web platform for restaurants to manage operations, orders, inventory, billing, and analytics; and (c) a delivery app for delivery partners to accept and fulfil delivery assignments.

When you place an order through our platform, you are making an offer to purchase food from the selected restaurant. We reserve the right to accept or reject your order. Once accepted, you will receive an order confirmation. Orders are subject to restaurant availability and acceptance.
All prices displayed are in Indian Rupees (INR) and are subject to change without notice. Prices may vary between restaurants and may include applicable taxes, delivery fees, and service charges. Final prices will be displayed before order confirmation. Restaurants are responsible for accurate pricing information.
Payment must be made at the time of order placement through the payment methods available in the platform. We accept various payment methods including credit/debit cards, UPI, digital wallets, and cash on delivery (where available). All payments are processed securely through third-party payment processors. You agree to provide valid payment information.
Delivery times are estimates and not guaranteed. We are not responsible for delays caused by factors beyond our control, including but not limited to weather conditions, traffic, restaurant preparation times, or delivery partner availability. Delivery fees may apply and will be displayed before order confirmation. You are responsible for providing accurate delivery addresses.
You may cancel an order before it is confirmed by the restaurant. Once confirmed, cancellation policies vary by restaurant. Refunds, if applicable, will be processed according to our refund policy and may take 5-10 business days to reflect in your account. Refunds for cash on delivery orders may require additional verification.
Restaurants using the EatNSay POS app, web platform, or both agree to:

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, images, and software, are owned by EatNSay or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
To the maximum extent permitted by law, EatNSay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Services. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free. We are not responsible for the quality, safety, or legality of food items provided by restaurants. We do not endorse any restaurant or food item.
You agree to indemnify and hold harmless EatNSay, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Services, violation of these Terms, or infringement of any rights of another party.
We reserve the right to modify these Terms & Conditions at any time. We will notify users of material changes by updating the "Last Updated" date and posting the updated terms on our website and in our applications. Your continued use of the Services after such modifications constitutes acceptance of the updated terms.
We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us or using account deletion features in the app.
These Terms & Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and EatNSay regarding the use of our Services and supersede all prior agreements and understandings.
